The NAIC and several state insurance departments have issued guidance or proposed rules requiring carriers to test their predictive models for disparate impact before deployment. For insurtechs whose value proposition rests on data-driven decision-making, proactively addressing bias is not only an ethical imperative but a strategic necessity — a model found to produce discriminatory outcomes can trigger enforcement actions, reputational damage, and loss of market access.
